These Terms and Conditions govern the services of David Martinez, specializing in therapeutic massage and personal training. By booking our services, the customer accepts these terms in full.
2. Services offered
David Martinez offers the following services:
- Individual and group personal training.
- Therapeutic, sports, and relaxation massages.
- Advice on health, well-being, and physical activity.
3. Bookings and appointments
- Bookings must be made in advance via our website, by phone, or in person.
- Appointment confirmation is subject to availability.
- It is recommended to arrive at least 10 minutes before the agreed appointment time.26
- Cancellations or changes must be communicated at least 24 hours in advance.
- Late cancellations will be charged at 25% of the service fee, while no-shows will be charged at 100% of the service fee.
- If the company cancels the service, a free replacement appointment will be offered.
4. Customer obligations
- The customer must inform staff of any relevant health conditions before the massage or training session begins.
- The company assumes no liability for pre-existing injuries or complications resulting from undisclosed health conditions.
5. Prices and payment methods
- Prices are available on our website and at our premises.
- Payments can be made in cash, by credit/debit card, or by bank transfer.
- Package deals and multi-session passes have a fixed validity period and are non-refundable.
6. Customer responsibility
- The customer confirms that they are in suitable health to use the services.
- It is the customer’s responsibility to inform us of existing injuries, illnesses, or health limitations.
7. Disclaimer for injuries
- David Martinez assumes no liability for injuries, pain, or complications arising from the use of our services.
- The customer participates in training sessions and massages at their own risk.
- It is recommended to consult a doctor before starting physical activity or treatment.
8. Company responsibility
- We are committed to providing high-quality services with qualified staff.
- We assume no liability for the loss of personal items on our premises.
- In cases of force majeure (e.g., therapist illness, legal restrictions), the appointment will be rescheduled free of charge.
9. Data protection
- The customer’s personal data will be treated confidentially and in accordance with applicable data protection regulations.
- Customer data will not be shared with third parties without explicit consent.
10. Changes to the Terms and Conditions
- The company reserves the right to change these terms at any time.
- Changes will be published on our website and/or communicated to customers.
11. Governing law and jurisdiction
- These terms are governed by the laws of Switzerland, Canton of St. Gallen.
- All disputes will be settled before the courts in Wil.
